2) Acceptance of the Terms
By registering an account or otherwise accessing or using the Service, you acknowledge that you have read, understood and agree to be bound by these Terms and by the Privacy Policy incorporated herein by reference. Acceptance is obtained via a click‑to‑accept mechanism. Tigo Labs may amend these Terms from time to time. Material amendments will be notified by reasonable means. Unless otherwise stated, amendments take effect upon publication; continued use of the Service after the effective date constitutes acceptance of the amended Terms.
2bis) Definitions (key terms)
For the purposes of these Terms: “Service” means the Simone application, websites and related services; “User Content” means information, data and materials submitted or uploaded by the user; “Outputs” means AI‑generated responses produced by the Service for the user; “Subscription” means a paid, auto‑renewing plan; “Trial” means time‑limited access without charge; “Beta/MVP” means pre‑release functionality subject to change.
3) Who May Use Simone
The Service is intended for persons of eighteen (18) years of age or older who have the legal capacity to contract. Where access is provided through an employer or other organization, additional terms may apply between the user and such organization. These Terms govern the user’s individual use unless superseded by a separate written agreement with Tigo Labs.
4) Description of the Service (MVP)
Simone is an AI‑assisted coaching service designed to facilitate personal and professional development through structured conversations, exercises and follow‑ups. The Service supports reflection and goal setting; it is not a substitute for professional services in regulated domains (including medical, psychological, legal, tax or financial services).
5) Beta / MVP Notice
The Service is provided in a minimum viable product / beta phase. You’re joining at an early stage where we improve fast and ship often. That means features may change, appear or disappear, and occasional hiccups can happen. We may also ask for feedback or collect technical data to make the experience better. We’ll do our best to keep things smooth, but uninterrupted availability isn’t guaranteed during the MVP. Personal data are processed as described in our separate Privacy Policy (available at https://simone.coach/privacy); §13 below provides a non‑exhaustive summary and does not replace the Privacy Policy.
6) Account & Security
Users shall provide accurate information and maintain the confidentiality of authentication credentials. Users are responsible for all activities conducted under their accounts. Tigo Labs reserves the right to suspend or terminate access where there is a breach of these Terms, suspected fraud, security risk or legal requirement. Users shall promptly notify Tigo Labs of any unauthorized use or security incident.
7) Plans, Trials, Billing & Cancellations
The Service may be offered under a free trial and paid Subscriptions and will be free of charge during the MVP phase. Subscription fees are denominated in euros (EUR) and are billed in advance for each term. Subscriptions renew automatically unless cancelled prior to renewal. Cancellation takes effect at the end of the then‑current term; access continues until that date. Payments are processed by third‑party payment processors and may be subject to their terms. For EU consumers, commencement of the Service prior to expiry of the statutory withdrawal period requires express consent and acknowledgment that the withdrawal right may be lost upon full performance. Except where required by law, fees are non‑refundable after the applicable withdrawal period. Data handling following cancellation or termination is governed by the Privacy Policy and the Data Retention rules (Annex C).
8) Pricing & Changes
We may change prices with reasonable notice as required by law. Price changes take effect at the next billing cycle.
9) Acceptable Use
Users shall comply with applicable laws and refrain from: (a) using the Service for unlawful, harmful or discriminatory activities; (b) uploading or transmitting content that infringes intellectual property, privacy or publicity rights or that contains malicious code; (c) attempting to access non‑public areas, bypass security or rate limits, scrape or reverse engineer the Service; or (d) using the Service to provide regulated professional advice to third parties. Tigo Labs may implement technical measures, including automated abuse detection and rate limiting, to protect the Service and its users.
10) Important Safety & Professional‑Advice Disclaimer
The Service provides general educational and coaching support only. It does not constitute medical or mental‑health care, legal, tax or financial advice, and is not suitable for emergencies. Users remain solely responsible for decisions taken on the basis of Outputs and should verify information before relying on it. In case of crisis or risk of harm, users must contact local emergency services.
11) User Content
Users retain ownership of their User Content. By submitting User Content, users grant Tigo Labs a worldwide, non‑exclusive, royalty‑free license to host, process and display such content solely for the purpose of providing, maintaining, securing and improving the Service (including personalization, memory functions, safety, quality assurance and technical operations). Users represent and warrant that they have all rights necessary to submit the User Content and that such content does not violate applicable law or third‑party rights.
12) Outputs & Model Behavior
Outputs may vary in quality and may contain inaccuracies. Subject to applicable law and third‑party rights, Tigo Labs assigns to the user any rights it may hold in the Outputs generated for that user for lawful personal use. Users remain responsible for verifying Outputs and for their use thereof.
13) Privacy & Data Protection (GDPR) - Summary
13.1 Controller and Contact
Tigo Labs SAS, 13 rue du Delta, 75009 Paris, France, acts as controller for the Service. For any request under Articles 15–22 GDPR (access, rectification, erasure, restriction, portability, objection), contact: contact@tigo-labs.com.
13.2 Categories of Personal Data
We process the following categories of data strictly necessary for the Service:
- Account Identifiers: email address; optionally name and profile preferences you provide.
- Interaction Content: messages, goals, tracks, notes and other inputs you submit; AI Outputs generated for you; memory items you elect to keep.
- Technical & Usage Data: device and app identifiers, IP address, timestamps, session metrics, crash/diagnostic logs, and feature usage necessary to maintain security, prevent abuse and improve performance. We do not require special‑category data (e.g., health) for the Service. If you choose to provide such information, it will be processed only as part of your Interaction Content and under the safeguards below.
13.3 Purpose Limitation and Lawful Bases
Personal data are processed solely to: (a) provide and maintain the Service and your account; (b) personalize sessions and memory features at your direction; (c) ensure security, fraud‑prevention and quality; (d) measure and improve functionality and user experience; (e) comply with legal obligations. Legal bases are performance of contract (GDPR Art. 6(1)(b)), legitimate interests (GDPR Art. 6(1)(f)) and consent where required (GDPR Art. 6(1)(a)). We do not use your data for third‑party advertising or for profiling unrelated to the Service. See also GDPR Art. 4(4) (definition of profiling) and Recital 71.

13.4 No Sale and No Third‑Party Sharing for Their Own Purposes
We do not sell personal data. We do not share personal data with any third party for that third party’s own purposes (marketing, analytics, data enrichment or otherwise).
13.5 Processors (Sub‑processors)
We may engage vetted service providers acting on our instructions only (e.g., hosting, payments, analytics, AI runtime) under written data‑processing agreements, confidentiality obligations and appropriate transfer safeguards. Such processors may not use your data for their own purposes.
13.6 International Transfers
Where data are transferred outside the EEA/UK, we implement appropriate safeguards such as European Commission Standard Contractual Clauses and additional technical/organizational measures.
13.7 Retention
We retain personal data only for as long as necessary for the purposes described above or to comply with legal obligations. Illustratively: session logs up to 12 months; memory items until you delete them or close your account; encrypted backups up to 30 days for disaster recovery.
13.8 Your Choices and Rights
You can review or delete memory items in‑app (where available) and manage email preferences. You may also exercise GDPR rights by contacting us. We will respond within statutory deadlines. If you believe your rights are infringed, you may lodge a complaint with your supervisory authority (in France: CNIL).
13.9 Disclosures
We do not disclose personal data to third parties except: (i) to processors acting on our behalf under §13.5; (ii) where required to comply with lawful requests or to protect rights, safety or the integrity of the Service; or (iii) with your explicit consent.
14) Feedback
If you provide ideas or suggestions (“Feedback”), you grant us a perpetual, irrevocable, worldwide, royalty‑free license to use the Feedback without restriction.
15) Intellectual Property
The Service, including software, models, prompts, UI and content (excluding User Content) is owned by Tigo Labs or its licensors and is protected by IP laws. No rights are granted except as expressly stated.
16) Third‑Party Services
The Service may interoperate with third‑party tools (e.g., calendar, storage, messaging). Their terms and privacy policies apply when you use them. We are not responsible for third‑party services.
17) Changes to the Service & Terms
We may modify features, impose limits, or stop providing parts or all of the Service. We may update these Terms; material changes will be notified by reasonable means. Continued use after changes means acceptance.
18) Suspension & Termination
Users may discontinue use of the Service or cancel their Subscription at any time. Tigo Labs may suspend or terminate access where a user breaches these Terms, poses a security or legal risk, fails to pay fees, or where required by law. Upon termination, access ceases and data will be handled in accordance with the Privacy Policy and applicable retention schedules.
19) Warranties Disclaimer
To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. Tigo Labs disclaims all warranties, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose and non‑infringement, and does not warrant uninterrupted or error‑free operation.
20) Limitation of Liability
Nothing in these Terms shall limit or exclude liability that cannot be limited or excluded under applicable law (including liability for death or personal injury caused by negligence or for wilful misconduct). Subject to the foregoing and to the extent permitted by law, Tigo Labs’ aggregate liability arising out of or related to the Service shall not exceed the amounts paid by the user for the Service in the twelve (12) months preceding the event giving rise to liability (or fifty euros (€50) if the user has only used the free Service). Tigo Labs shall not be liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, revenue, business or data. Users agree to indemnify and hold Tigo Labs harmless against claims arising from their unlawful use of the Service or breach of these Terms.
21) Communications
Tigo Labs may send service, security and legal notices electronically, including by email or in‑app messages. Marketing communications are subject to consent and include an unsubscribe mechanism.
22) International Use & Export
You are responsible for compliance with local laws and export controls when accessing the Service from outside France/EU.
